Six men and two women, aged between 18 and 25, were crammed into a Mitsubishi Lancer two-door coupe that veered off the Princes Highway in Clayton and jumped a large median strip before smashing into a pole, about 12.40am.

It is believed the driver of the car was a learner driver and that a majority of the occupants were members of Melbourne's Sudanese community.

One of the victims, Jennifer Chapman, remained in hospital last night. Her family provided The Age with a picture that clearly shows her pain.

Victoria Police Chief Commissioner Christine Nixon said earlier today as long as all of the car's seatbelts were being used, overloading the vehicle with people was not a crime.

"No, it's not an offence,'' she told Radio 3AW.

"It's a matter for the driver to see whether they can drive properly.

"In fact it's the number of seat belts. I think it's four or something in this car, and if those people had the seatbelts on, no, it's not an offence.

"It's just the technical part of the law.

But RACV's general manager of public policy, Brian Negus, told The Age having eight people in a car that seated four was totally unacceptable.

"And even if the four seats were able to be used and that's probably even some doubt and given eight people crammed in there, how do you get lap-sash seatbelts on?" he asked.

''And apart from anything else, you've got four people in the car not wearing seatbelts and if it's not illegal then the Government
should move to change that,'' Mr Negus said

Two parts of this amaze me - that you could fit 8 people in a Lancer coupe and that it is not illegal.

This makes no sense at all...

So inthe beginning or the article its said to be legal...but its illegal to have more people than seatbelts in a car, and this car had 8 people and 4 seatbelts... :rolleyes:

EIGHT THATS IT! We had done that plenty of times in college, thats it just part of college, at least once you have to see how many people you can cram in a car. Now they just need a better driver, try doing it with a foot of snow on the ground.

Seriously who hadnt tried to see how many people they can cram in a car at some point in their lives.
