    FRANKFURT -- A German court has ruled former Volkswagen CEO Martin Winterkorn must stand trial on fraud charges in connection with the company's diesel emission scandal in which it sold cars with software that let them cheat on emissions tests.

    The three-judge panel in Braunschweig in Volkswagen's home region of Lower Saxony ruled that car buyers suffered a financial loss when they bought a car without being aware it was equipped with illegal software. The court found a “predominant likelihood” of conviction in the fraud charge.

    It said four other defendants would face trial on charges of fraud in connection with aggravated tax evasion and illegal advertising. Dates for a public trial are to be set later.

    Winterkorn, who denied wrongdoing, resigned from Volkswagen days after the U.S. Environmental Protection Agency announced a notice of violation on Sept. 18, 2015. The company had for years been using software that recognized when vehicles were on test stands and turned emission controls on, then turned the emission controls off during normal driving. As a result, the cars emitted far more than the legal U.S. limit of nitrogen oxide, a pollutant that harms people's health.

    Winterkorn also faces criminal charges in the U.S. but cannot be extradited. Volkswagen paid more than 30 billion euros ($33 billion) in fines and settlements over the scandal.

    The three-judge panel did not accept all accusations levelled by prosecutors when they first charged Winterkorn in April 2019.

    True. He denies wrong doing but yet with something this big how could he not know or be involved at some level. He is ultimately accountable for what goes on in his corporation underneath him.

    Even if he didn't know, which I doubt, as I recall he created the poisonous environment that leads to stuff like this. He may not have pulled the trigger, but he made it so others would. I've seen it throughout my career with rich executives that will never want for money taking advantage of regular folks who need a paycheck to pay the mortgage. Make diesels do something that is technologically impossible or you'll lose your job.....

    Of course he knew, the development of a clean diesel in 2007 was reviewed by Winterkorn and other heads
    who were seeking to cut VW massive company costs. The preferred SCR emission system was presented
    along with the less favoured but cheaper catch and hold NOX trap that cycles rich-lean to burn off the NOX.

    The problem was that the SCR system would add $3 billion projected cost to VW, so the powertrain chief
    was told to make the cheaper system work. The heirachy culture at VW was such that little or no push back
    was tolerated from subordinates but tied to that was reporting of problems with the system and the suggestion
    that a Bosch test program software be used to achieve a compliant test on demand (wheels locked and rear ABS disabled)

    The response from the superior was damning, "Don't get caught" and they wouldn't have if clean diesel wasn't
    brought to the USA but even then, it was dumb luck that they got caught, had a software upgrade worked,
    the EPA would have been none the wiser. There was also plenty of opportunity for VW to move to a more
    compliant system with the US vehicles and retro add the system to Europe but no, and that's why they fail.

    I remember Lutz saying for years that GM could do it, but not at the cost of VW, and they eventually did, launching small diesels in the United States that meet the standards including commiefornia

    Lutz also said that GM tried the same NOX trap equipment that VW was using for its clean diesel
    but could never get it to work and the rich-lean cycling made for worse fuel economy.

    The whole thing was a lie, marketed to great advantage to an eager buyer demographic
    that believed in clean diesel.

    The same diesels built by GM Powertrain were fitted in Opel/Vauxhalls and still failed to comply with EU emission regulations.

    The difference was the Euro engines didn't have a diesel particulate filter,
    not a defense, just an observation of a broken system under reform.

    Of course they had a DPF - it's been a legal requirement in the EU since 2011 to meet Euro 5 and Opel/Vauxhall had fitted them on some diesels much earlier to meet Euro 4 - eg Vectra-C 150PS diesels.

    If you mean they didn't have SCR/Adblue (aka DEF), you're right - exactly the same situation as VW Group which only fitted SCR/Adblue to the V6/V8 diesels, not the 4-cylinder ones, until forced to by dieselgate.

    Maybe I'm reading this conversation incorrectly, but NOx and particulates are two different things.

    Regardless, Winterkorn effectively cost VW $33 billion, a lot of money. Besides that, the guy must've been a real jerk.
