My parents did a buyback with their 2001 Silverado. You're in for a long battle....

Re: Has anyone Gone through a lemon law case with a silverado?

I went through a repurchase under Ohio's lemon law (law since revised/updated) for a 1997 Chevrolet Camaro Z-28 convertible 30th anniversary model, purchased new. It experienced 14 separate defects during the first 4,000 miles and was in the shop more than 30 days.

I used the BBB arbitration process and handled the matter myself. The BBB was very helpful and efficient. Chevrolet was NOT helpful and their representative treated me very poorly. The Chevrolet representative chose not to attend the BBB hearing, although her office was nearby. She chose to participate by conference telephone call and she was late.

In Ohio, the lemon law required that I participate in the BBB arbitration, which was binding on Chevrolet / GM, but not me.

The arbitrator ordered a refund of my purchase price and sales tax, minus $.25 per mile usage until the first defect occurred (at 697 miles...). I paid cash for the vehicle, so financing charges did not apply (although they would have also been refunded under Ohio's law).

The Ohio law required that I return the car to my dealer and the dealer would refund the money, and be reimbursed by GM. The dealer called and made an appointment for me to return the car with the clear title after receiving a packet from GM. When I arrived, the dealer refused to refund the money because GM had failed to deposit the money in their account and I was sent home with the car.

I took the car home and filed another BBB complaint. I was contacted shortly by the dealer again, and received a refund.

Many states, including Ohio, include attorney fees in the settlement if the consumer prevails.

You SHOULD NOT give up. Research the lemon law for your state and determine if your circumstances apply. At the time, the "lemon" had to fit one of four categories. My car fit three of four. Read your owner's manual and determine what your state law requires.

Good luck. It is a time consuming process. I was treated very well by the dealer where I purchased the car, where I had done business for years. I was treated VERY POORLY by the Chevrolet Zone Office representative.

You did not post the year of the truck or if it was purchased new, or the defects. Most state lemon laws apply to the original purchaser / leasee of a new vehicle and the defects have to occur within a specific period of time - usually 1 year or 12,000 / 18,000 miles - what ever comes first.

Re: Has anyone Gone through a lemon law case with a silverado?

Hi sorry, Mine is a 2005 ...I bought it new august 2005 It had its first problem at 1615 miles then its been a downhill battle ever since.. mostly with overheating.. and steering issues.. its a 3500 dually diesel 4x4 . I live in pa and the lemon law states the first problem has to be experienced in the first year or 12000 miles and as long is its still under manufactuers warranty its eligible for the lemon law. I have a stack of repair orders an inch thick.. I had it scheduled for bbb arbitration back in august 2006 but due to family health issues I had to cancel the arbitration process at that time. I left the vehicle parked in the garage untill spring of 2007 then figured i try to get the problems fixed again instead of the bbb process. I like the look and ride of the truck but it was not reliable and left me sitting on the side of the road one to many times. The last time being with my wife and infant son in the truck. I have always had gm vehicles and have always had good service with them.. except for this one.

thanks again
